Police look to charge 3 men after Patriots fan died following fight at Dolphins game

Investigators in Massachusetts are searching for three Rhode Island men in connection with the death of Dale Mooney, a New England Patriots fan who died after a fight at Gillette Stadium during the Week 2 game against the Miami Dolphins.

The Foxborough Police Department announced on Thursday that investigators had applied for criminal complaints alleging assault and battery and disorderly conduct against three Rhode Island men from that incident that happened on September 17.

“The applications for complaint submitted by the Foxborough Police Department will now be scheduled for a probable-cause hearing before a clerk or assistant clerk in the Wrentham District Court in the coming weeks,” police said in their statement Thursday morning.

The men's names have not been released, but they will now wait for a judge to determine probable cause. If the clerk finds probable cause to issue the charges, the names of the individuals will become public record.

The cause of Mooney's death has not yet been determined. Initial autopsy reports do not showcase any traumatic injuries but did determine a serious medical issue.

Investigators said they feel confident they have the correct men after reviewing several camera angles of the incident and after getting testimonies from several witnesses to the altercation. One fan, Joseph Kilmartin, actually recorded the incident on the stadium's 300-level. Kilmartin said that, nearing the end of the fourth quarter, Mooney approached a man in a Miami Dolphins jersey that Mooney and his friends had been jawing with for most of the game.

"He basically grabbed another fan," claimed Kilmartin. "They started tussling around for a few minutes. At one point, another fan walked over. He punched him, and the man just went out."

After the fight, first responders performed CPR on Mooney at the stadium before escorting him to Sturdy Memorial Hospital in Attleboro. He was pronounced dead there.

Friends, fans raise funds for Dale Mooney's family

Mooney leaves behind his wife Lisa and his two children. Lisa Mooney told reporters that the whole situation has left her numb. She stated, "I just can’t even believe this is for real."

Mooney had been a Patriots season ticket holder for nearly 30 years at the time of his death.

A GoFundMe page made to help Mooney's family has raised more than $32,000. Several local charities have also stepped in to help Lisa Mooney and her children. According to Max Sullivan of the Portsmouth Herald, part of the USA TODAY Network, the Riverworks Restaurant in Newmarket, Mooney's hometown, has decided to donate 15% of their proceeds this Sunday to the Mooney family.

The circumstances surrounding Dale Mooney’s death remain under investigation by Foxborough and State Police.
